General Conditions of Sale
By placing an order on both www.RegalaunAlbero.com and on www.RegalaUnAlbero.net (the "Website') which are owned and operated by Infinity Edge srl, with registered office in Via Po 53, 10124 Torino, and registered office in Via Emanuele Gianturco 1, 00196 Rome. P.IVA 10215850016 (the Seller") , the Customer declares to have taken vision of all the indications provided to them during the purchase procedure, and to accept in full the general and payment terms and conditions set out below.
Object of Purchase
The Customer buys from the Seller the kit with dedication and certificate of the chosen tree, as better described in the Site, as well as contributes to the costs of planting service of the tree in one of the lands of which the Seller can exploit in Italy: the set of such products and services is defined as the 'Gift'. It is understood that, according to the rules on the access, the property of the tree belongs to the owners of the land used each time. In order to protect the overall forest area, the owners of the lands will be able to intervene on the tree, remove it or cut it down in compliance with normal rules on forestry activity. The customer has the right to access the soil, by appointment to be set through the Site, to be able to view their dedicated tree. In any case, it is understood that, in case of purchase in season not suitable for planting, the tree will be planted later, following the course of the season of the location and good forestry practice, or be dedicated to a newly planted tree on behalf of Regala un Albero.
Mode of Purchase
The correct receipt of the order is confirmed by the Seller through a reply via e-mail, sent to the e-mail address communicated by the Customer. This message of Confirmation will report the date and time of the order and a "transaction code" to be used in any subsequent communication with the Seller.
It is the Customer’s responsibility to register with true and correct data and to keep the date current by means of accessing credentials.
Terms of Payment
The purchase of the Gift is performed by Paypal or credit card. All amounts displayed on the Site are expressed in Euro, which is the reference currency. On request, the customer can make the payment by bank transfer by contacting info@regalaunalbero.com.
Delivery Methods & Costs
For each order placed on the Website, the Seller shall invoice the material sent, sending the invoice by e-mail to the owner of the order, pursuant to art 14 D.P.R. 445/2000 and decree 52/2004. For the issue of the invoice, the information provided by the Customer at the time of the order will be used. No change in invoice will be possible after the issue.
The delivery costs of a Kit, in the Italian territory, via tracked parcel are included in the price of the Gift purchased. In the case of deliveries abroad or urgent deliveries in Italy by express courier, the Site will inform the Customer of the costs of delivery of the Kit, which must be paid separately and in any case before the dispatch.
The lead time from the order of a single tree are a maximum of three working days, while for larger orders will be agreed on a case-by-case basis. No responsibility can be attributed to the Seller in case of delay in delivery of the Kit by the postal/express service.
At the time of delivery of the goods by the courier, the customer is required to control and make sure:
that the number of packages delivered corresponds to what is indicated on the document of transport;
that the packaging is intact, not damaged, nor wet or otherwise altered, including packaging material (adhesive tape or metal straps).
Any damage to the packaging and/ or to the kit or incorrect number of packages or wrong indications, must be immediately contested, by issuing a written CHECK RESERVE on the courier’s proof of delivery. Once signed the courier document, the customer will not be able to oppose any dispute about the characteristics of what has been delivered.
Any problems regarding the physical integrity, correspondence or completeness of products received must be reported within 7 days from the delivery, as stated in this document.
In case of failure to collect within 5 working days of the material stored at the post office of relevance due to repeated impossibility of delivery at the address indicated by the customer at the time of the order, the order will be automatically cancelled, but the amount paid will be retained by the Seller as compensation for the activity already occurred.
Rights of Withdrawal
Pursuant to art. 5(3) of Legislative Decree no. 185 of 22 May 1999, the right of withdrawal of the Customer from this agreement is excluded, taking into account that the Gift Kit is customized for the Customer with the dedication indicated by him/her.
Limitations of Liability
Any rights of the Customer to compensation or damages is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order. In addition, Regala un Albero is not responsible for any non-vegetation of the tree for natural causes, therefore substitutions of the said tree are excluded.
In case of unexpected unavailability of the goods and non-acceptance of the order, no charge will be made to the Customer.
